These Terms of Service (“Terms”) govern your access to and use of the website westlakesmilestudio.com and any related online forms, scheduling tools, messaging features, SMS/text messaging, or digital services we make available (collectively, the “Site”). The Site is operated by Westlake Smile Studio (“Westlake Smile Studio,” “we,” “us,” or “our”), located at 960 S. Westlake Blvd Ste 204, Westlake Village, CA 91361.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Informational purpose only

The Site provides general information about our dental practice, services, and team. Content on the Site is for educational and informational purposes only and is not a substitute for professional dental advice, diagnosis, or treatment. Always seek the advice of a qualified dental professional with any questions about a dental condition. Do not disregard professional advice or delay seeking care because of something you read on the Site.

2. No doctor–patient relationship from Site use alone

Using the site, submitting a contact or consult request, sending a message, or viewing content does not by itself create a doctor–patient relationship. A doctor–patient relationship is formed only through our customary clinical intake and acceptance processes.

3. SMS / text messaging terms (required disclosure)

By providing your mobile phone number to Westlake Smile Studio (including through our website forms, online scheduling, virtual consult requests, patient intake, or by asking our team to text you), you consent to receive SMS/text messages from or on behalf of Westlake Smile Studio at that number.

3.1 Types of messages you may receive

Message types may include, but are not limited to:

• Appointment reminders, confirmations, cancellations, and rescheduling notices;
• Waitlist and opening availability alerts;
• Treatment, follow-up, and post-operative care reminders;
• Billing, insurance, and payment-related notices;
• Requests for forms, reviews, or feedback;
• Practice updates related to your care or visits; and
• Replies when you text our practice.

We do not use this SMS program for unrelated third-party marketing without your separate consent where required by law.

3.2 Message cadence

Message frequency varies based on your appointments, care needs, and account activity. You may receive multiple messages in connection with a single visit (for example, reminder, confirmation, and follow-up). Typical volume for active patients is a few messages per appointment cycle, and otherwise only as needed for your care or account. Exact frequency is not guaranteed.

3.3 Message and data rates

Message and data rates may apply. Your mobile carrier’s standard messaging and data rates apply to any SMS you send or receive. Westlake Smile Studio does not charge a separate fee for SMS, but your carrier may.

3.4 Opt-out instructions

You can opt out of SMS at any time by replying STOP to any text from us. After you text STOP, you may receive one final confirmation message that you have been unsubscribed. To resume messages later, reply START or contact the office and request to be re-enrolled. For help, reply HELP or call us at (805) 513-1001.

3.5 Privacy and SMS data

Your consent to receive texts is not a condition of purchasing goods or services. Mobile information will not be shared with third parties or affiliates for their own marketing or promotional purposes. We may use service providers (such as our patient communication / dental intelligence platform) to send texts on our behalf. How we collect, use, and protect personal information is described in our Privacy Policy.

That Privacy Policy is incorporated into these Terms by reference.

3.6 Carrier disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network availability.

4. Appointments, communications, and contact forms

If you request an appointment, virtual consult, callback, or other contact through the Site, you authorize us to contact you at the phone number, email, or other contact details you provide, including by call, text, or email, about your request and related practice communications, subject to the SMS terms in Section 3. You are responsible for providing accurate contact information.

Information you submit through online forms may be subject to re-disclosure and, depending on the channel, may not be protected by HIPAA in the same way as information exchanged inside our clinical systems. Do not use Site forms to send urgent medical concerns or emergency information.

5. Emergencies

If you are experiencing a dental or medical emergency, call 911 or go to the nearest emergency room. Do not rely on the Site or SMS for emergency care.

6. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy.

7. Intellectual property

All content on the Site, including text, graphics, logos, images, videos, design, and software, is owned by Westlake Smile Studio or our licensors and is protected by copyright, trademark, and other laws. You may view and temporarily download materials for your personal, non-commercial use only. You may not copy, modify, distribute, publicly display, sell, or create derivative works from Site content without our prior written permission, except as allowed by law.

Before-and-after photos and patient images on the Site are illustrative and may not predict results for any individual. Results vary.

8. Acceptable use

You agree not to:

• Use the Site in any way that violates applicable law;
• Attempt to gain unauthorized access to the Site, accounts, systems, or networks;
• Interfere with or disrupt the Site or related servers;
• Scrape, harvest, or use automated means to access the Site without our written consent;
• Upload or transmit malware or harmful code;
• Misrepresent your identity or affiliation; or
• Use the Site to send spam or unsolicited advertising.

9. Third-party links and tools

The Site may link to third-party websites or use third-party tools (for example, scheduling, messaging, SMS, payment, or analytics providers). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

10. No warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WESTLAKE SMILE STUDIO AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR SMS SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SMS SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED.

Nothing in these Terms limits liability that cannot be limited under California law, including liability for gross negligence or willful misconduct where such limitation is prohibited.

12. Indemnification

You agree to defend, indemnify, and hold harmless Westlake Smile Studio and its owners, officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site or your violation of these Terms.

13. Changes to the Site or Terms

We may update the Site or these Terms at any time. The “Last updated” date will change when we revise these Terms. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate access to the Site or SMS communications at any time, without notice, for any reason, including if we believe you have violated these Terms, subject to applicable law and any required notices.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Exclusive venue for disputes arising out of or relating to these Terms or the Site will be the state or federal courts located in Ventura County, California, unless applicable law requires otherwise.
